MobileMe IT – Terms and Conditions

Welcome to MobileMe IT. These Terms and Conditions govern your use of our services and apply to all in-store, on-site, and online transactions with us. By using our services, you agree to be bound by the following terms:

 

1. Services Provided

MobileMe IT provides repair services for cellphones, laptops, and other electronic devices, along with IT support, networking, structured cabling, cybersecurity solutions, and related professional services. All services begin with a diagnostic assessment, and work is only performed upon your approval of the estimate.

 

2. Estimates & Payment

  • All estimates are based on our initial diagnostic findings. If additional issues are identified during service, we will notify you and obtain your verbal or written approval before proceeding.
  • A non-refundable diagnostic fee of $135 is charged upfront. This fee covers time, tools, and expertise used to assess your device or system and is due whether or not you proceed with repairs.
  • Payment for all services is due upon completion unless otherwise agreed in writing.

 

3. Data Loss Disclaimer

You are solely and entirely responsible for backing up your data before bringing in any device or system for service.

By using our services, you acknowledge and agree that MobileMe IT is not liable for any data loss, corruption, or damage, regardless of the cause. This includes, but is not limited to:

  • Technician handling
  • Hardware or software failure
  • System crashes
  • Malware or virus exposure
  • Power loss or unforeseen complications

This limitation of liability applies even if:

  • You were unaware of the need to back up your data
  • You assumed data would be preserved
  • You failed to ask about data protection
  • You did not review or receive backup recommendations

We take reasonable precautions, but no guarantee is expressed or implied regarding the preservation, recovery, or integrity of any data.

 

4. Warranty

We offer limited warranties based on the type of service performed:

  • Covers parts and workmanship for a specified period, communicated at the time of service.
  • Excludes accidental damage, water or liquid exposure, abuse, software issues, and third-party tampering.
  • Warranty is void if the device is opened or altered by anyone other than MobileMe IT.
  • Proof of service and purchase is required to process any warranty claim.

 

5. Limitation of Liability

To the fullest extent permitted under Florida law, our total liability is limited to the amount paid for the service rendered.
We are not responsible for indirect, incidental, or consequential damages, including (but not limited to) lost profits, lost data, device replacement, or business interruption.

 

6. Abandoned Devices

Devices not picked up within 60 days of service completion may be considered abandoned.

  • We will make multiple attempts to contact you.
  • After 60 days, we may recycle, resell, or dispose of the device to recover our costs.
  • No compensation will be issued for abandoned devices.

 

7. SMS/Text Messaging

By providing your mobile number, you consent to receive text messages related to:

  • Appointment reminders
  • Repair updates
  • Missed call follow-ups
  • Review requests
  • Promotional offers (if you’ve opted in)

To opt out, reply “STOP” at any time.
Message and data rates may apply based on your carrier. We do not share your mobile number with third parties for marketing.
We comply with all 10DLC (10-Digit Long Code) regulations and industry standards.

 

8. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

9. Dispute Resolution

Any disputes will be resolved in accordance with Florida law and must be filed in a court of competent jurisdiction located in Miami-Dade County, Florida.

 

10. Entire Agreement

These Terms represent the complete agreement between you and MobileMe IT and supersede any prior oral or written agreements related to our services.

 

11. Severability

If any part of these Terms is found to be invalid or unenforceable, all remaining provisions will remain in full effect.

 

12. Changes to These Terms

We may update these Terms at any time. Changes will be posted to our website with the updated “Last Updated” date. Continued use of our services constitutes acceptance of the revised Terms.
